(2) If the installments consist of qualified domestic partnerships taxable income, for the purposes of section 6050 N(a)(3)(A)(i) the term “taxable income” means the income of the partnership for the taxable year in which payments on the installment agreement are due. (3) If the payments on the installment agreement are due on December 31 to December 31, a late payment penalty may apply for the total amount of payments due on the installment agreement beginning on such later date. No liability for penalties. (1) If the amount due from the taxpayer is less than the amount on which the penalty relates, no penalty may be imposed on the taxpayer. (2) This section shall not be construed to require the payment for any tax on a nonremittance of an installment, or to require the payment of installments for property acquired by the taxpayer after the due date of the installment agreement.
